{"id":10397,"date":"2022-08-24T06:00:16","date_gmt":"2022-08-24T13:00:16","guid":{"rendered":"http:\/\/www.trulioo.com\/?p=10397"},"modified":"2024-01-04T23:05:15","modified_gmt":"2024-01-04T23:05:15","slug":"customer-identification-program","status":"publish","type":"post","link":"https:\/\/www.trulioo.com\/blog\/kyc\/customer-identification-program","title":{"rendered":"Managing Customer Identification Program Requirements"},"content":{"rendered":"\n<p>The <a href=\"\/blog\/kyc\/ensure-cip-runs-smooth\">Customer Identification Program<\/a>&nbsp;(CIP) requirements that govern financial institutions target money laundering, terrorism funding, corruption and other criminal activities but also present challenges for organizations. Under a CIP, which is required through the USA PATRIOT Act, entities must have \u201creasonable\u201d procedures to gather and maintain customer identity information and run watchlist checks on them.<\/p>\n\n\n\n<p>The Financial Crimes Enforcement Network (FinCEN) <a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/09\/15\/2020-20325\/financial-crimes-enforcement-network-customer-identification-programs-anti-money-laundering-programs\" target=\"_blank\" rel=\"noopener\">has stated CIP requirements<\/a>&nbsp;should apply to all banks, regardless of whether they are federally regulated.<\/p>\n\n\n\n<p>But those requirements raise questions: What do regulators consider&nbsp;reasonable? How can a financial institution integrate a CIP efficiently and cohesively? Can organizations achieve compliance and fraud mitigation while delivering efficient customer onboarding?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-customer-identification-process\">The Customer Identification Process<\/h2>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.ffiec.gov\/press\/PDF\/FFIEC%20BSA-AML%20Exam%20Manual.pdf\" target=\"_blank\" rel=\"noopener\">minimum identity requirements<\/a> to open an individual financial account in the U.S. are name, birth date, address and an identification number, such as Social Security or Individual Taxpayer Identification.<\/p>\n\n\n\n<p>Gathering that information at account opening is sufficient, but organizations must verify the account holder\u2019s identity \u201cwithin a reasonable time.\u201d Procedures for identity verification include documents, such as a driver\u2019s license, or nondocumentary methods, such as through credit bureaus and government databases.<\/p>\n\n\n\n<p>Those procedures are at a CIP\u2019s core, and organizations, as they do with other <a href=\"\/blog\/aml-compliance\">Anti-Money Laundering<\/a>&nbsp;(AML) compliance&nbsp;requirements, can ensure compliance by codifying the policies. The exact policies depend on the organization\u2019s risk-based approach and may include:<\/p>\n\n\n\n<ul>\n<li>The types of accounts offered<\/li>\n\n\n\n<li>The methods of opening accounts<\/li>\n\n\n\n<li>The types of identifying information available<\/li>\n\n\n\n<li>The organization\u2019s size, location and customer base, including the types of products and services used by customers in different locations<\/li>\n<\/ul>\n\n\n\n<p>The identity verification procedures must be robust enough to verify the identity of each customer to an extent that is \u201creasonable and practicable.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"900\" height=\"300\" src=\"https:\/\/www.trulioo.com\/wp-content\/uploads\/2019\/02\/Customer-Identification-Program-electronic-identity-verification.jpg\" alt=\"Customer Identification Program - electronic identity verification\" class=\"wp-image-18477\" srcset=\"https:\/\/www.trulioo.com\/wp-content\/uploads\/2019\/02\/Customer-Identification-Program-electronic-identity-verification.jpg 900w, https:\/\/www.trulioo.com\/wp-content\/uploads\/2019\/02\/Customer-Identification-Program-electronic-identity-verification-740x247.jpg 740w, https:\/\/www.trulioo.com\/wp-content\/uploads\/2019\/02\/Customer-Identification-Program-electronic-identity-verification-96x32.jpg 96w\" sizes=\"(max-width: 900px) 100vw, 900px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-case-for-digital-identity-verification\">The Case for Digital Identity Verification<\/h2>\n\n\n\n<p>Traditionally, financial institutions would examine unexpired government-issued identification documents such as a driver\u2019s license or passport. However, best practices call for providing more than one document to offset the risks of counterfeit or fraudulently obtained identification.<\/p>\n\n\n\n<p>Financial institutions can conduct that process online to meet consumer expectations for convenience and immediacy in a digital age. Digital identity verification through nondocumentary methods can provide strong risk mitigation and deliver fast onboarding. One method involves \u201c<a href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/31\/1020.220\" target=\"_blank\" rel=\"noopener\">independently verifying the customer&#8217;s identity<\/a>&nbsp;through the comparison of information provided by the customer with information obtained from a consumer reporting agency, public database, or other source.\u201d<\/p>\n\n\n\n<p>There are other nondocumentary methods, such as contacting a customer, checking references with other financial institutions or obtaining a financial statement. However, those processes don\u2019t often offer the speed, convenience and reliability of digital identity verification.<\/p>\n\n\n\n<p>Financial institutions can also combine documentary and nondocumentary methods. One increasingly popular method is to use on-demand&nbsp;<a href=\"\/solutions\/identity-verification\">ID document verification<\/a>&nbsp;combined with digital identity verification to cross-check ID documents electronically with the identity information to further reduce fraud risk.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-other-cip-requirements\">Other CIP Requirements<\/h2>\n\n\n\n<p>While obtaining and verifying the identity of each customer is core to the CIP, there are other requirements, including record retention, sanction checking and providing proper notice to customers about document collection and identification processes.<\/p>\n\n\n\n<p>The CIP must also contain procedures to handle various edge cases, such as when a person doesn\u2019t have an identity document, when a document type is unknown to the financial institution or when a customer can\u2019t visit a branch.<\/p>\n\n\n\n<p>Regulations require the financial institution\u2019s CIP also incorporate procedures to manage situations when the risk level is higher than usual. Those procedures can answer questions such as: What happens when the institution can\u2019t verify a person\u2019s identity? When is it appropriate to prevent account opening? When is it OK to open the account but require more information? When should an organization close an account or file a suspicious activity report?<\/p>\n\n\n\n<p>While a CIP is mandatory, organizations can rely on another qualified financial institution as the program provider. The qualified entity must be regulated and have an AML program, and the reliance must meet&nbsp;<a href=\"https:\/\/ecfr.federalregister.gov\/current\/title-31\/subtitle-B\/chapter-X\/part-1020\/subpart-B\/section-1020.220\" target=\"_blank\" rel=\"noopener\">CIP standards<\/a>.<\/p>\n\n\n\n<p><strong>Record retention<\/strong><\/p>\n\n\n\n<p>Identity information must be maintained for five years past the customer\u2019s relationship with the financial institution. That includes a description and expiration date of any document used to verify identity, including its identification number and the issuance date and location.<\/p>\n\n\n\n<p><strong>Sanctions<\/strong><\/p>\n\n\n\n<p>Financial institutions must also check identities against domestic and international AML, counter-terrorist financing and sanctions&nbsp;<a href=\"\/solutions\/aml-watchlist-screening\">watchlists<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-business-verification\">Business Verification<\/h2>\n\n\n\n<p>The CIP also applies to corporations, partnerships and trusts. In those cases, the procedures relate to verifying a business entity. The existence of the business entity can be established by calling upon certified articles of incorporation, a government-issued business license, a partnership agreement or a trust instrument.<\/p>\n\n\n\n<p><a href=\"\/solutions\/business-verification\">Business verification<\/a>&nbsp;is also possible through nondocumentary methods. Similar to digital identity verification, real-time identification and verification of company records through official registers enables quick business onboarding.<\/p>\n\n\n\n<p>It\u2019s important to note that under the&nbsp;<a href=\"\/blog\/identity-verification\/fincen-final-cdd-rule\">Customer Due Diligence Final Rule<\/a>, collecting, maintaining and reporting beneficial ownership information is now required for financial institutions, which \u201cmust identify and verify the identity of the beneficial owners of all legal entity customers (other than those that are excluded) at the time a new account is opened (other than accounts that are exempted).\u201d<\/p>\n\n\n\n<p>Under the&nbsp;<a href=\"\/blog\/business-verification\/corporate-transparency-act\">Corporate Transparency Act<\/a>, U.S. companies must report their Ultimate Beneficial Owner (UBO) information to FinCEN. Any new incorporation or significant UBO change must be reported, and any company formed before the effective date of the act will have two years to report.<\/p>\n\n\n\n<p>A CIP is a necessary element of <a href=\"\/blog\/aml-compliance\">AML<\/a> and&nbsp;<a href=\"\/blog\/kyc\">Know Your Customer<\/a>&nbsp;(KYC) regulations. Beyond that, it\u2019s part of an effective risk-mitigation strategy. Ensuring your CIP is strong, up to date and complete is fundamental to running a successful financial institution.<\/p>\n\n\n\n<p><em>This post was originally published in February 2019 and updated to
